1. Acceptance of Terms
By creating an account or using Comet ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These terms apply to all users, including students, clinicians, and institutions. Hoshiyomi Innovation ("we", "us") reserves the right to update these terms at any time. Continued use after changes are posted constitutes acceptance.
2. Description of Service
Comet is a browser-based cephalometric analysis tool that helps orthodontists and dental students place landmarks on X-ray images, compute measurements, and manage patient records and image galleries.
The Service is currently in beta. Features, availability, and pricing are subject to change. We may suspend or discontinue the Service at any time, though we will give reasonable notice where possible.
3. Eligibility & Accounts
You must be at least 18 years old to create an account. By registering, you confirm that the information you provide is accurate and that you will keep it up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@hoshiyomi.io if you suspect unauthorised access.
4. Medical Disclaimer
Comet is a clinical support tool, not a substitute for professional clinical judgment. All measurements, analyses, and norm comparisons are informational only.
Treatment decisions must be made by a qualified, licensed dental or orthodontic professional. We accept no liability for clinical outcomes arising from reliance on data produced by the Service.
5. Patient Data
You are solely responsible for obtaining any consents required by applicable law before uploading patient data, X-ray images, or photographs to the Service. This includes but is not limited to consent under PDPA (Thailand), GDPR (EU/EEA), or HIPAA (USA) as relevant to your practice.
We process patient data strictly on your behalf, as described in our Privacy Policy. We do not access, use, or share your patient data for any purpose beyond operating the Service.
6. Acceptable Use
You agree not to:
- Upload data belonging to patients without proper consent
- Attempt to access other users' data or reverse-engineer the Service
- Use the Service for any unlawful purpose
- Automate access or scrape data without written permission
- Upload malicious files or attempt to disrupt the Service
We reserve the right to suspend or terminate accounts that violate these terms without notice.
7. Beta Period
Comet is currently offered free of charge during the beta period. Beta access includes all current features with no usage limits and no credit card required.
When Comet exits beta, paid plans will be introduced. Existing users will receive at least 30 days' notice before any free tier changes or billing begins. You will never be charged without explicit consent.
8. Paid Plans (Future)
When paid plans are introduced, the following will apply:
- Subscriptions will be billed monthly or annually in advance
- All fees are non-refundable except where required by law
- You may cancel at any time; access continues until the end of the paid period
- We reserve the right to change pricing with 30 days' notice to existing subscribers
9. Intellectual Property
The Comet application, branding, and all original content are owned by Hoshiyomi Innovation. You may not copy, modify, or distribute any part of the Service without written permission.
You retain full ownership of all patient data and images you upload. By uploading content, you grant us a limited licence to store and serve that content solely for the purpose of operating the Service on your behalf.
10. Limitation of Liability
To the fullest extent permitted by law, Hoshiyomi Innovation shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.
Our total aggregate liability to you for any claim arising under these terms shall not exceed the amount you paid us in the 12 months preceding the claim (or THB 500 if no payment has been made).
11. Governing Law
These terms are governed by the laws of Thailand. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Thailand, unless otherwise required by the law of your country of residence.
